20 questionsThe Personal Data Protection Commission (PDPC) is an independent Commission established by the government to oversee the implementation of the Personal Data Protection Act, Chapter 44 of 2022, where the objectives of this Act are:-
(a) To Control the Collection and Processing of Personal Data.
(b) Ensure that the Collection and Processing of Personal Data of the Data Subject You are guided by the principles laid down in this Law.
(c) Protect the Privacy of Individuals.
(d) Establish Legal and Institutional procedures to Protect Personal Data.
(e) To give the parties of the Data rights and relief in protecting Personal Data from Collection and Processing that does not comply with the provisions of this Law.
This commission was officially established on May 1, 2023 following the adoption of the Personal Information Protection Act, Chapter 44 of the Year 2022.
(a) Supervising the implementation of the Personal Data Protection Act in the country.
(b) To register the collectors and processors of Personal Data in the country.
(c) To receive, investigate and handle complaints about alleged violations of the Protection of Personal Data and Privacy of people.
(d) Conduct research and monitor the development of Technology related to Data Processing.
(e) To strengthen cooperation with other countries.
It is any Data that can identify a person. For example Names, Emails, Phone Number, Identification Number etc.
There are two types of Personal Data and they are:-
(a) Common Personal Data:- These are common Personal Data that can identify a person and if they are misused, the consequences may not be very serious. For example Names, Phone Numbers, Identification Numbers (Nida, Zanzibar Resident, License, Passport) etc.
(b) Sensitive Personal Data:- These are Personal Data that can identify a person and if this Data is misused, it can cause serious harm to the subject of the Information. For example Genetic Information (DNA), Fingerprints, Eyes, Face (Biometric) Health Data, Banking Data, Religion Data, Political Data, Data on the status of marriage, family and children in general, etc.
Data Collector is any Person, Institution/Office whether Public or Private that collects Personal Data from Data Subject.
Data Processor is any Person, Institution/Office whether Public or Private that processes (uses) Personal Data to provide services to the Data Subject on behalf of the Data Collector.
DPO is any person appointed by the Data Collector/Data Processor (Head of Institute, Company/Office) and given the responsibility of Supervising the Implementation of the Personal Data Protection Act, Chapter 44 of 2022 (PDPA) at his Institution/Office.
Anyperson can be a Data Protection Officer (DPO) of an Institution/Company regardless of their Profession or Citizenship, as long as they are at least 18 years old and Mental fit.
